Terms of Service
The rules for using cofre.trade and for buying, selling and trading cards with us. By using the site you agree to them, so please read them. If you don't agree, please don't use the site.
Who we are
cofre.trade (“Cofre”, “we”, “us”) is run by Cofre LLC, a Florida business that buys, sells and trades graded Pokémon cards. “You” means anyone who uses the site. How we handle personal information is covered by our Privacy Policy.
Using the site
- You may browse, read and share links to any page, and use the site's tools for your own, personal use.
- Please don't misuse the site: no spam, no false or misleading submissions, no attempts to break in, overload or interfere with it, and no automated bulk copying (scraping) of its listings or price data without our written permission. Search engines indexing the site is fine.
- You must be at least 18 to buy from us or sell to us, or have a parent or guardian handle the deal.
- We may change, pause or remove any part of the site at any time.
Listings, prices and availability
- Each listing is one specific card (or the quantity shown). Prices are in US dollars and don't include shipping or any sales tax that applies. We'll confirm the total before you pay.
- We may also sell a card elsewhere, so a listing can sell before we see your request. A listing comes off the site automatically once the card is sold, usually within minutes.
- We try to describe every card accurately, but mistakes happen. If a price or description is wrong, we may correct it and cancel any request based on the error, before or after you've contacted us. If you've already paid, you'll get a full refund.
- Sold results show what a card sold for on a public auction or marketplace, with a link to the sale. Where the auction house adds a buyer's premium, the price shown may include it. Past results are not an offer to sell at that price.
How buying works
There is no online checkout. Sending “Buy this card”, “Make an offer” or a question is a request, not a completed purchase:
- You send the request with your name and how to reach you.
- We confirm by email (or phone, if that's what you gave us) that the card is still available and that it's yours, and tell you the total, payment options and shipping.
- The sale is agreed when we confirm it in writing and you pay. We may decline any request or offer.
- We ship once payment has cleared.
Offers are reviewed one by one. An offer is not accepted until we say so in writing.
Grading and authenticity
- The cards we list are graded by third-party grading companies such as PSA, Beckett (BGS) and CGC. The grade is the grading company's opinion, shown as they state it on the label. We don't grade cards ourselves and can't promise how another grader, or a regrade, would come out.
- We check each listed card's cert number against the grading company's public records. Where we show a cert number, you can check it yourself on the grader's website.
- A grading company's own guarantee, if it offers one, is between you and that company, under its terms.
- Slab cases can carry small scuffs or scratches that are hard to see in photos. Ask us before you buy if you'd like more pictures of the actual card.
- If a card we sold you turns out to be counterfeit or doesn't match its slab or cert record, contact us and, once it's back with us in the same condition, we'll refund the full price, including shipping.
Payment, shipping and returns
- Payment: we'll email you the payment methods we accept for your purchase. The card ships after payment clears.
- Shipping: cards ship insured with tracking. We'll tell you the shipping cost before you pay. For shipments outside the US, any import duties, taxes or customs fees are yours to pay.
- Lost or damaged in transit: tell us within 3 days of delivery (or once tracking shows the package lost). We handle the insurance claim and refund you or send a replacement of equal value if one is available.
- Returns: all sales are final, except for a card that isn't as described (wrong card, grade or cert) or isn't authentic. In that case contact us within 7 days of delivery, before you open or alter the slab, and we'll arrange the return and a full refund.
- Your rights under consumer protection laws that can't be waived are not affected.
Selling or trading to us
- Sending a card through Sell to us or the collection value tool asks us for an offer. It doesn't commit you to anything.
- Our offers (cash, trade credit or auction consignment) are not binding on either side until we both agree in writing, by email is fine. An offer is based on the photos and details you sent, and on the market that day. It stays open for 7 days unless we say otherwise.
- Once we've agreed, we send you a prepaid, insured shipping label. When the card arrives we check that it matches what you described: the card, the grade, the cert number and the condition of the slab. If it does, we pay you the agreed amount the day it arrives, or apply the trade credit.
- If it doesn't match, we'll tell you why and either offer a revised price or send the card back to you insured at our cost. You choose.
- You confirm that you own the card, have the right to sell it, and that, as far as you know, it is genuine and not stolen.
- Auction consignment is covered by a separate written agreement that sets out fees and timing.
- We use your photos only to evaluate your card. We don't publish them without your permission.
Market reports, prices and news
The market update, card and set prices, indexes, charts, guides, news notes and “Cofre's take” are for general information. They are not financial, investment or tax advice, and not a recommendation to buy, sell or hold anything. Collectible cards can lose value. Past prices and trends don't guarantee future value.
Price data comes from third parties (TCGplayer via TCGCSV, Cardmarket via TCGdex, eBay listing counts and published grading fees and pull rates) and is updated about once a day. It can be delayed, incomplete or wrong, and we don't guarantee it. “Cofre's take” and our news commentary are our own opinions. News notes summarize other outlets' reporting in our words and link to the original source, which is responsible for its own content. A price shown on the site is not an offer from us to buy or sell at that price.
Trademarks and content
Pokémon and Pokémon character names are trademarks of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company. PSA, BGS, Beckett, CGC and other grading companies' names are trademarks of their owners. Cofre is not affiliated with, endorsed by or sponsored by any of them; we use these names only to describe the cards.
The site's own text, design, logo, charts, reports and photos belong to Cofre or are used with permission. You may quote a short part of a page with a link back to it. For anything more, ask us first. Card images and data from third parties remain the property of their owners.
Links to other sites (auction houses, marketplaces, news outlets, grading companies) are for your convenience. We aren't responsible for their content, terms or privacy practices.
Disclaimer and limitation of liability
The site and its information are provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent the law allows. We don't promise the site will always be available or error-free.
To the fullest extent the law allows, Cofre and its owners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, trading or investment losses, or lost data, arising from your use of the site or its information. For any claim about a purchase or sale with us, our total liability is limited to the amount you paid us, or we paid you, for that card. For any other claim it is limited to US$100. Some places don't allow these limits, so they may not all apply to you.
You agree to cover Cofre's reasonable losses and costs (including legal fees) arising from your misuse of the site or your breaking these terms.
Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, and you and we agree to their jurisdiction. Before going to court, please contact us so we can try to sort it out.
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given it up. These terms, together with whatever we agree in writing for a specific deal, are the whole agreement between us about the site.
Changes
We may update these terms. The new version applies from the effective date shown at the top. A deal already agreed stays under the terms that applied when it was agreed.
